Syed Hamid's Explanation on Detention of Sin Chew Daily News Reporter

I find Home Minister, Datuk Seri Syed Hamid Albar’s explanation that Sin Chew Daily reporter Tan Hoon Cheng was detained under the Internal Security Act as police believed that her life was “under threat” to be totally unacceptable. It was a feeble attempt to justify the use of the ISA on Tan. By detaining her under the ISA, police has turned her into a “victim” of circumstances. By doing so, the police have caused added emotional distress and mental agony to Tan and her family.

Moreover, Datuk Seri Syed Hamid’s explanation that the detention was made by police without his knowledge is also not consistent. As the Home Minister, he should be responsible for any actions undertaken by the police, especially when it involves the sensitivities of the people. As a former member of the Cabinet, sensitive issues are discussed at the weekly Cabinet meetings before any decision is taken. As a senior Minister, Datuk Seri Syed Hamid must be very familiar with these procedures. Also, an important decision such as detention under the ISA should be referred to the Prime Minister for his advice.

In view of the recent developments, the government should abolish the ISA or relook at the ISA to put in place a rigorous system of checks and balances before any decision is taken to detain someone.

内政部长赛哈密对星洲日报记者陈云清在内安法令下被扣留所作的解释是,她的性命面对威胁,我认为,这种解释完全不能被接受。以这个理由援引内安法来逮捕陈云清是站不住脚的。警方利用内安法拘捕她,使她成为了大环境的牺牲者。警方这么做,令她和家人的情绪和精神都感到痛苦万分。

此外,赛哈密解释说,他并不知道警方采取这项逮捕行动。这个解释也不符合事实。身为内政部长,他应该对警方所采取的任何行动,尤其是涉及人民的敏感问题的行动负责。我担任内阁成员时,所有的敏感问题在做出决定之前,必须先在每周的内阁会议上讨论。身为一位资深的部长,赛哈密必须非常熟悉这个程序。 此外,援引内安法令进行扣留这么重要的事件,应该先向首相请示才能做出决定。

鉴于最近的事态演变,政府应该废除内安法令,或者重新检讨这项法令,以便实行严格的调查和衡量体系,才可以做出逮捕任何人的决定。

While Teresa Kok (accused)was aleged to have make some sensitive issue by Kil Toyo (plaintiff), regarding religous, hence, she (accused) had been detained under ISA.

Similarly, this A_mad Ismail (accused) was aleged to have make some sensitive issue by Sin Chew reporter, Ms Tan (plaintiff), regarding racial, supprisingly, she (plaintiff) was detained under ISA. (Why ! What Logic ! How come!)

What more can I said !! Malaysian, more accurately, Malaysia Government had successfully choose to become a laughing stock in the eye of the international comunities !!

I have noticed that some of you guys (being current/ex BN cabinet members) have voiced out disagreements towards the ISA arrests and some even expressed "shock".Even the home minister said that the arrests have nothing to do with him (??). So, who made the decision to proceed with the arrests? Who has absolute power to do it? Is there a serious manipulation of justice and democracy? Please, for crying out loud, don't treat us like idiots. This is an insult to our intelligence. Free RPK and Teresa and stop all these nonsenses.

Syed Hamid should not have done what he did and should not have said what he said.

This incident should not have happened at all. Being a matured politician, he should have considered a consultation process to investigate further rather than take a confrontation approach.

Putting someone in a lockup on the pretext of protecting that person is ridiculous and a cretinic action.

If the comments are yours personally and your party MCA remains silent on the issue, then perhaps it is time you quit MCA and join PR as some your former party leaders like Tan Tee Kew have done.

I totally agree with you Datuk Seri. As a Home Minister, he is responsible for all actions taken by the police. The reporter should not be detained by ISA and released her after 20 hours. This will only create fear among the press and also the public. Furthermore, the antigovernment sentiment among Rakyat will be increased after this incident. Datuk Seri, you hv raised your unsatisfaction and anger which we as malaysians of all races fully support you.

If BN wants to reform and gain back the confidence of Rakyat in order to win back 2/3 majority or rather i would say not lose totally PR, some unqualified ministers in cabinet should resign or change. If not BN will not stay long and will become opposition.

It is time to form a new alliance .. not with stupid UMNO. What are the politicians doing these days? Having easy time in their offices?
I reckon is time for the people to think carefully whether we still want to have impotent politicians running the administration.

PM and his cabinet have failed for years to bring the country to next chapter. Political survival become top agenda. Have they forgotten the mandate? Or they are just blind and deaf at the same time?

As a citizen, i loss patient and hope with PM. Many times he has shown his incompetency and lack of discipline in running the nation.

I said let's give them a second wave of wake up call by voting opposition in the next election. Can't wait for new leadership !! Mahathir is still the best PM this country ever have...

What troubled me Datuk Seri, why bring this serious matter up in your blog. Should it not be brought up by MCA, as a component party of BN and demand, that these innocent civilians be set free right away.
It is apparent, ISA was designed to suppress UMNO's opponents and allow the 'untouchables' in UMNO to play the race card freely without fear.
You and those in MCA are guilty, to allow this undemocratic act to go unhindered and practiced.
A real disgrace!

Put it this way, when a Government is uncertain of what it is doing, as in the case of the arrests of the three under ISA, it is a clear sign that that Government is no longer relevant and that either its leaders are replaced or the parties that make up the ruling coalition are deposed through democratic means, such as governing party elected representatives defecting to the Opposition and allowing the Opposition to form a new Government with a sufficiently strong majority.
I feel that it's time that parties like MCA, Gerakan, LDP, SUPP, SAPP, SPDP, PRS, PBS or their elected representatives join a new coalition and in the case of Malaysia join the Pakatan Rakyat which is led by a younger and more capable Malay/Muslim leader Anwar Ibrahim who commands the respect of the people within Malaysia and outside the country such as in Asia, Africa,Europe and America.

Time to do that is NOW.

I agree with your views on the effects of the ISA arrests.
I have a simple question:
Isn't it very clear that Umno is not prepared to change its out-moded views and stand on issues of common interest to Malaysians of all races and religions?
What are you waiting for?
If for some reason you are unable or don't want to join the new Pakatan Rakyat coalition either collectively or individually, then may I suggest you stay out of the BN and vote with your conscience in Parliament.
If, for instance, there is a no confidence vote in Parliament, think of the larger interest of the nation and its people and vote according to your conscience what you think is the best for the community, the nation and its people.

So now the government has become so caring that anyone deemed under threat will be "protected" by them under the ISA? Hmmm... yes, minister, we believe you.

With all due respect to you, from my past acquaintance with you, I appreciate your action here in speaking the truth.

Knowing you in person as a great gentleman, you have done no other MCA politician dares to question the line of detention; an illogically & lame-excused action aimed at silencing the opponents/opposing forces of the UMNO led BN government.

It has been too long for MCA and other component BN parties to remain silent and suffer in pain & dignity-losing decisions by UMNO.

Stand up and correcting a wrong or wrongs is divine and any God-fearing being shall not stand still to allow injustice be inflicted upon the innocent; lest be termed as not carrying out the words of God.

We will be judged as the holy books say; particularly on what we do on this earthly world. Let's us all be conscious about this fundamental duty of ours, "Be fair to all fellow beings".

Datuk Seri, I hope with your leadership here in advocating this call for justice would wake up all your MCA colleagues and Gerakan/MIC/other BN component parties contemporaries in taking the course you have taken here.

Keep up the work. All politicians should act in accordance to their self-conscience in decision making and shall not be apolitical. The US has a marvelous stance on national issues without any party toeing across the political divide. Malaysian politicians shall only be able to mature if this is adopted. The rakyat is more educated now and demands change. Only with change shall there be progress.

As what I saw in the News, Dato' Sri Hamid Albar comment on the act are really unacceptable. Agreed with you. I don't agree with the statement by Dato' Sri Hamid, it's obviously that UMNO members being protected but not the civilians. Why must they take an action using the (ISA) laws to the civilians but not to their members who start the problem?. If they are thinking that it should be the responsibility by UMNO as the parties, why not they urge PKR to take action to the MP Teresa and RPK, and also Sin Chiew to Miss Tan?

Realistically, support towards MCA among the Chinese has been dwindling since recent scandals took place. Many are blaming you and the rest of MCA for not taking immediate, difficult actions while lobbying for the opposition parties who have an easier job of complaining. For a simple comparison, just compare the supportive comments in your blog and the prominent opposition party leaders' ones (eg Lim Kit Siang etc).

I have no confidence in Pakatan Rakyat's leadership ability. I do not believe that they will form a strong government, now.

But what then are their selling points? They pledge to be transparent. They pledge to be just to everyone. They pledge to eradicate corruption. And more importantly, they pledge to be Bangsa Malaysia, not Bangsa Melayu, Cina and India.

And the whole country has called upon BN for an effective leadership and change of mindset in this new age. People are more educated and not everything can be swept under the carpet, especially during these times when opposition parties are more than ready to pounce on any half-chances to topple the government.

I have mixed feelings about 916 but I think what's more important is the desire and effort to change, whether or not 916 exists.

Datuk Seri, the time's almost up and if BN continues to fail in serving the people or even worse, continues to dream that they are serving well, then BN is headed for doom definitely. Malaysian young people are not sadists, they dont enjoy instability and constant political tactics. Instead, many of them are true Malaysians at heart, proudly presenting themselves as rakyat Malaysia. As for BN, all we can say is - show us your support and we'll show you ours.

Syed Hamid's actions and handling of the matter has further eroded the credibility of the Govt and Barisan. Collective responsibility is one thing but collective responsibility for incompetence...?
I am glad that you have spoken out for RPK and Teresa as well. While I am not a supporter of RPK, if he has done something wrong- charge him in court. Similarly, charge Teresa. UMNO have again underestimated the Malay community's ability to see through this wayang kulit which is going to end with the complete humiliation of UMNO.
For 26 years we have allowed principles to be sacrificed for the Barisan and the so called 'greater good' of the country. It is now time for the Barisan to sacrifice for principle and country.
As the grandson of pendatang from Yemen where honour among men is highly valued, Syed Hamid must resign, resign, resign and prove that there are honourable men in the Government.

Datuk Seri,I totally agreed with you that the ISA should be abolished. The detention of the Sin Chew reporter under ISA is a full illustration of incompetent government! ISA to charge a messenger who reported on Ahmad Ismail who openly spreading racist remarks but not Ahmad Ismail who spreading racist remark??? If BN can't rule Malaysia as a multi racial country, opposition parties to take over is inevitable, I'm not sure if that were to happen it is for good or worst as a rakyat Malaysia, but the current ruling government is just too weak, incompetent and disappointing to comprehend. The only days where i supported MCA was when i was still in secondary school decades ago, since then i've not seen anything that could lure me to admire what MCA has done or is doing.

Your goodself, it's time you start agressively voicing out what the rakyat want and a better choice will be pull out of the coalition and join PR.

Teresa Kok is being detained under ISA for what has been reported by Utusan, but why isn't the person who report this from Utusan being detained under ISA just like the reported fron Sin Chew, Ms. Tan Hoon Cheng?

And since Ahmand Ismail is NOT being charged under ISA for what he has said (even though it is the fact that he DID say the chinese are 'squatters'), why is Teresa Kok being charged for what she DIDN'T do?

For the specific people who is plotting this entire eposide: YOUR STORYLINE SUCKS - worse than a B grade movie!!

If the election is held tomorrow, I would vote for a Pas candidate rather than a MCA candidate.

Today, MCA can only solve problems by press statements. It does not seem to be able to influence events. MCA ministers are sidelined on important issues.

MCA would have to work very hard to convince otherwise.
